Prisca Holidays Club Membership

Effective Under the Indian Contract Act, 1872 and Applicable Indian Laws


1. Parties & Legal Framework

This Agreement is entered into by and between the subscriber of the Club Membership (“Member”) and Prisca Holidays (“Company”), a proprietorship firm operating under the laws of India. By subscribing to the Club Membership, the Member agrees to be bound by these Terms in accordance with:

  • The Indian Contract Act, 1872,
  • The Consumer Protection Act, 2019,
  • The Information Technology Act, 2000,
  • The Prize Chits and Money Circulation Schemes (Banning) Act, 1978,
  • And other relevant and applicable statutes.

2. Membership Subscription and Duration

2.1 The Club Membership becomes active upon successful payment and registration.

2.2 The membership is non-refundable and non-transferable beyond seven (7) business days from the date of subscription, in accordance with the right to rescind under Section 62 of the Indian Contract Act, 1872.


3. Coupon Usage Policy

3.1 A Member may use coupons only on pre-defined packages as listed on the official Prisca Holidays website.

3.2 Only one coupon per booking is permitted, either of ₹2,000 or ₹5,000.

3.3 Coupons may be gifted to friends or family; however, only the original Member is entitled to raise booking requests on behalf of the beneficiary.


4. Hotel Booking Guidelines

4.1 Booking Intimation Requirement:

  • Domestic travel: Minimum 7 days prior notice.
  • International travel: Minimum 15 days prior notice.

4.2 No last-minute (“eleventh-hour”) bookings will be accepted.

4.3 Hotel availability is subject to third-party inventory. The Company provides access to its hotel network but makes no guarantee of availability.


5. Custom Hotel Requests

5.1 If the desired hotel is not listed, the Member may submit a written request via registered email with:

  • Hotel name,
  • Travel dates,
  • Number of travellers.

5.2 Request Timelines:

  • Domestic hotel rate requests: Minimum 11 business days in advance.
  • International hotel rate requests: Minimum 30 business days in advance.

5.3 Disclaimer: The Company does not guarantee rates will be cheaper than market prices, but strives to provide discounts ranging from 10% to 25%, subject to property location and classification.


6. Referral Program and Sponsored Travel

6.1 Prisca Holidays does not engage in Multi-Level Marketing (MLM), Ponzi, or Pyramid Schemes as defined under the Prize Chits and Money Circulation Schemes (Banning) Act, 1978.

6.2 Any misuse of the membership for such activities shall result in termination of membership without refund and possible legal action.

6.3 Referral Reward: On every four (4) successful referrals, the Member is eligible for a sponsored trip for 2 adults, inclusive of:

  • Domestic: Kerala, Goa, Himachal, Andaman.
  • International: Thailand, Dubai, Bali, Singapore.

6.4 Complimentary inclusion of:

  • One child under 4 years (domestic),
  • One infant under 2 years (international).

7. Flight Policy for Sponsored International Trips

7.1 Flights are included only in international memberships.

7.2 The Company reserves the right to:

  • Decide the airline,
  • Determine the travel route and schedule,
  • Deny specific flight preferences.

8. Service Disclaimers

8.1 The Company is not liable for any service-related shortcomings caused by third-party providers (e.g., hotel, cab vendors, etc.).

8.2 Members are not entitled to vendor invoices or payment vouchers for sponsored packages.


9. Force Majeure and Liability Waiver

9.1 The Company shall not be held liable for loss, damage, delay, or injury arising from circumstances beyond its control including, but not limited to:

  • Natural calamities (earthquakes, floods),
  • Terror attacks or riots,
  • Accidents (road, air, or sea),
  • Theft, loss of baggage or belongings,
  • Disease outbreaks or epidemics.

9.2 The Member acknowledges that travel involves inherent risks and indemnifies the Company from any claims arising due to such incidents.


10. Data Protection

10.1 All Member data shall be processed and stored in compliance with the Information Technology Act, 2000 and related Rules on data privacy and protection.

10.2 Member information will only be shared with relevant third-party vendors for the purpose of fulfilling service obligations.


11. Governing Law and Jurisdiction

11.1 These Terms shall be governed by the laws of the Republic of India.

11.2 Any disputes shall be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan, under Section 20 of the Code of Civil Procedure, 1908.


12. Modifications and Notices

12.1 Prisca Holidays reserves the right to amend these Terms at any time without prior notice.

12.2 Continued usage of membership services shall be deemed as consent to the revised Terms.
